The UVV BGV A3 „Electrical systems and equipment” requires employers to carry out regular safety checks on electrical systems and equipment. Occupational health and safety regulation The Operational Health and Safety Regulation (BetrSichV) outlines the requirements for the provision and use of equipment as well as for the operation of systems subject to monitoring. The Technical Rules for Operational Health and Safety (TRBS) specify the BetrSichV with regard to identifying and assessing dangers as well as deriving appropriate measures. Similar to the Work Safety Act, the BetrSichV Regulation targets employers directly. The employer is therefore legally required to provide safe equipment for their employees. The inspection obligation applies for all operations, companies, the public sector, the Federal Armed Forces, the THW, fire brigades, etc., effectively all areas in which people use electrical apparatus as work tools. Breaches of this regulation are no longer just considered an administrative offence, they can also be considered a criminal offence subject to fines up to an including a prison sentence. This may be the case if an employer does not inspect the equipment for reasons of cost and faulty equipment leads to an accident. Regular inspections are necessary to ensure the safety of equipment (e.g. hand-held electrical equipment/tools) over their entire service life. The inspection must be carried out by „qualified persons”, whose vocational training, professional experience and their recent professional activities ensure that they have the necessary expertise to inspect the equipment.
